I am applying for credit, check-cashing and/or marker privileges from the Mohegan Tribal Gaming Authority ("MTGA"), doing business as Mohegan Sun. I hereby certify that the information provided in my application is true and accurate and that I have not omitted or concealed material information. I understand that MTGA is authorized under applicable laws, including Mohegan Tribal law, to operate Mohegan Sun as a gaming facility and that this application and any extension of credit hereunder shall be governed by, construed and enforced in accordance with the laws of the Mohegan Tribe and other applicable laws. I am providing information in this credit application as an inducement to MTGA to grant me credit, to accept my check or marker, and/or to obtain cash, chips or other consideration. I understand that if I omit material information or provide false or inaccurate information on my application, I may be subject to civil and/or criminal penalties. I agree that MTGA has the right to revoke any credit extended to me, and to take action to collect any debt owed by me.
I understand Mohegan Sun is established on the reservation lands of the Mohegan Tribe of Indians of Connecticut, a federally recognized Indian nation. I understand that the Mohegan Tribe has enacted ordinances which, among other things, govern gaming, debts and civil liability on the Tribe's reservation in Connecticut. I HEREBY ACKNOWLEDGE AND AGREE THAT MTGA MAY INSTITUTE AND MAINTAIN ANY SUIT INVOLVING THIS APPLICATION OR THE EXTENSION OF CREDIT HEREUNDER IN ANY COURT OF COMPETENT JURISDICTION, INCLUDING, WITHOUT LIMITATION, THE MOHEGAN TRIBAL GAMING DISPUTES COURT AND ALL COURTS IN THE STATE OF CONNECTICUT, WHICH I ACKNOWLEDGE AND AGREE SHALL HAVE PERSONAL JURISDICTION OVER ME FOR ANY LITIGATION ASSOCIATED WITH THIS APPLICATION OR THE EXTENSION OF CREDIT HEREUNDER.
I understand that, if MTGA provides me with chips in exchange for a check, marker, promissory note or other obligation to pay, the chips are the equivalent of cash. I agree that a marker or other promise to pay signed by me constitutes a debt to MTGA and may be negotiated by MTGA in the same manner as a check. I understand that if my check, marker or other payment obligation is dishonored by a financial institution because of insufficient funds in the account, because the account was closed, because of a stop payment order or for any other reason, I may be exposed to criminal penalties in addition to any civil remedies. I authorize MTGA to collect the costs, interest and attorneys' fees incurred in connection with efforts to collect any debt owed by me.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I HEREBY WAIVE ANY RIGHTS AS I MAY HAVE TO NOTICE AND/OR HEARING PRIOR TO THE EXERCISE BY MTGA OF ANY AND ALL PREJUDGEMENT REMEDIES. I AUTHORIZE MTGA TO APPLY, SUSPEND OR SET-OFF ANY GAMING WINNINGS, JACKPOTS, PRIZES, MOMENTUM CLUB POINTS OR COMPLIMENTARIES EXTENDED TO ME AGAINST ANY DEBTS OWED BY ME, INCLUDING THE COSTS OF COLLECTION THEREOF. I AGREE THAT, WHENEVER I HAVE AN OUTSTANDING MARKER, I WILL CONTACT THE MTGA CREDIT DEPARTMENT AT THE CONCLUSION OF EACH TRIP TO MOHEGAN SUN AND SETTLE OR MAKE ARRANGEMENTS TO SETTLE ALL OUTSTANDING MARKERS AND APPLY ALL WINNINGS TO ANY DEBTS OWED TO MTGA. TO THE BEST OF MY KNOWLEDGE, I AM NOT INSOLVENT OR CONTEMPLATING BANKRUPTCY AND NO SUCH PROCEEDING HAS BEEN INSTITUTED AGAINST ME.
I authorize MTGA to: (a) investigate and to verify the information that I have provided; (b) review and analyze my credit record; (c) furnish information concerning my credit application to credit reporting agencies and others who may properly receive this information; and (d) take other steps consistent with the investigation and verification of my financial resources and financial responsibility.
NOTICE: In the event that we deny credit based in whole or in part on an investigative consumer report about you from a consumer reporting agency, you will be given notice of such adverse action and given an opportunity to obtain a free copy of such report from the consumer reporting agency.
